How is a National Vaccine Injury Compensation Program claim decided?

A National Vaccine Injury Compensation Program (NVICP) claim is decided by a Special Master of the United States Court of Federal Claims in Washington, D.C. Based upon the petition, records, and testimony submitted, the claimant must show that he or she has meet the requirements for bringing a claim under the NVICP. The claimant must also show that the injury was caused by the vaccination and the extent of injuries. Testimony of expert witnesses is usually necessary to do so. Decisions of the Special Masters may be appealed to the United States Court of Federal Claims.
