In Florida, the misfilling of a prescription by a pharmacist is malpractice. Pharmacists have the legal obligation to insure that what is given a patient is what is ordered by the physician. This is the pharmacist's job. When the pharmacist fails to fulfill this duty, the pharmacist and their employer are legally responsible for the consequences.
Misfilled prescriptions are far too common. A steady stream of horror stories are reported in the news. Unfortunately, these reports are just the tip of the iceberg. Studies indicate that the percentage of misfilled prescriptions in the United Stated may be as high as 2 or 3 percent of the prescriptions filled! Most of these misfilled prescriptions result in no obvious harm to the patient. However, a significant percentage do result in serious harm.
